POLICY STATEMENT AND PURPOSE
The Sathapana Bank Plc’s Learning Management System (“Sathapana Academy”) is enabled to, the free of charge and benefits, the active Sathapana Bank employees and other persons to whom are being legitimately granted and acknowledged by Sathapana Bank Human Resources. The Sathapana Academy is leaded and charged by the Learning and Development Unit that plays a important role to administer and monitor the Sathapana Academy to ensure optimal performance, user accounts, user privacy and data shall be safeguarded and confidential in Good Standard Practice and provides technical supports for all users,
SCOPE OF POLICY
To assist Sathapana Bank Plc. in compliance with the applicable policies, procedures, and laws; this document addresses as important guideline and roadmap in the use of the Sathapana Academy. The use of Sathapana Academy is subject to the following terms and conditions (“Terms of Use”). By using Sathapana Academy, all Users agree to the terms as set out below.
1. RIGHT OF USE
1.1. Only active Sathapana Bank Plc.’s employees and other persons to whom are being legitimately granted and acknowledged by the Sathapana Bank Human Resources entitles to access the Sathapana Academy system.
2. USER OBLIGATIONS
2.1. Users agree to:
2.1.1. Only use Sathapana Academy for Sathapana Bank Plc. - affiliated activities;
2.1.2. Active Sathapana Bank Plc.’s employees and other persons to whom are being legitimately granted and acknowledged by Sathapana Bank Human Resources shall comply with the Sathapana Bank policies and the Term of Use. In the event of any of Sathapana Bank Plc.’s employee or any other person breached or commit to breach the Sathapana Bank Policies and/or the Terms of Use may be subject to disciplinary action or suspension of access;
2.1.3. Comply with all applicable laws, rules and regulations, including [Privacy Policy] as well as the [Sathapana Bank Cybersecurity Policy], and the Terms of Use;
2.1.4. Use reasonable online security precautions with regards to accessing and using Sathapana Academy, including maintaining the security of usernames, passwords, and any other access credentials assigned. Access credentials may not be shared or given to anyone other than the User to whom they are assigned;
2.1.5. Collaborate with Sathapana Bank Plc. in the event of reasonable investigation of outages, security problems, and any suspicious breach of the Terms of Use or other Sathapana Bank Plc.’s policies or applicable laws and regulations;
2.1.6. Comply with all license terms and terms of use, as applicable, for any software or content used or displayed within the Sathapana Academy environment;
2.1.7. Give Sathapana Bank Plc. accurate, current, and complete information that may be useful and required for the optimal performance of Sathapana Academy, and keep such information correct, complete and up-to-date;
2.1.8. Agree to designated IT and Human Resources personnel to access their account information and review and perform assessment activity including, but not limited to viewing learning outcomes, course analytics, and usage, for purposes of managing the program and continuous quality control;
2.1.9. Use reasonable efforts to prevent unauthorized access to or use of Sathapana Academy, notify Sathapana Bank Plc. of any known or suspected unauthorized use of User's account, or any other breach of security.
3. UPDATES TO THE TERMS OF USE
3.1. Sathapana Bank Plc. may update and change the Terms of Use in its sole discretion at any time.
3.2. Any such changes, if made by Sathapana Bank Plc., will be effective immediately for all new Users without notice.
3.3. Any User who does not agree to any changes in the Terms of Use after receiving notice of such changes shall notify the Human Resources Department within thirty (30) days; otherwise, continued use of Sathapana Academy constitutes full acceptance of the updated Terms of Use.
4. INTELLECTUAL PROPERTY RIGHTS
4.1. Intellectual Property rights attach to all software, hardware or other items and facilities (including documentation) provided by Sathapana Academy, is owned by Sathapana Bank Plc. and/or its licensors, including instruction materials. All data, details, information, and other documents/content that Users submit, send or place within the Sathapana Academy environment remains the property and responsibility of the user (“User Content”). Sathapana Bank Plc. is not responsible to pre-screen all User Content but may screen it based on its sole discretion.
4.2. User grants Sathapana Academy, during User’s use of the Sathapana Academy system, a fully paid, perpetual, worldwide, irrevocable, royalty-free, non-exclusive, and fully sublicensable license to use, distribute, reproduce, modify and adapt its User Content for purposes of operating and providing the Sathapana Academy system to Users.
5. SUSPENSION AND TERMINATION OF USE
5.1. Users shall not abuse the Sathapana Academy system and shall comply with all system usage policies. Examples of abuse include racist, sexist, explicit, homophobic, violent, threatening, or insulting content.
5.2. Sathapana Bank Plc. is entitled to temporarily suspend access to Sathapana Academy in case of abuse. Employee discipline may result from abuse of the Sathapana Academy system.
5.3. Sathapana Bank Plc. is entitled to permanently terminate access to Sathapana Academy in case of serious abuse, if any:
5.3.1. Violated User of the Terms of Use, and does not remedy within a reasonable timeframe upon notice; or
5.3.2. In Sathapana Bank Plc.’ reasonable judgment, termination is necessary to protect Sathapana Bank Plc. or any other party from the operation, security, or other risks;
5.3.3. Sathapana Bank Plc. is entitled to end access for all Users who no longer are affiliated with Sathapana Bank Plc., immediately after such affiliation (such as employment or consultancy, etc) Such Users must discontinue using Sathapana Academy immediately and may no longer use any part of the Sathapana Academy system for any reason.
6. LIABILITY
6.1. User agrees and undertakes if there is any damage which incurred as a result of its misconducts or wilful negligence access to and/or breached the terms of use of the Sathapana Academy system, shall be responsible for Sathapana bank Plc. as set forth in Human Resource Policy and Guideline of Sathapana Bank Plc. as well as an employment contract.
6.2. If there is a conflict between the articles in this Terms of Use and all applicable laws, local laws, rules, and regulations shall override this Terms of Use.
